RE: The tariff classification of three 100% cellulose filament woven fabrics from France

Dear Ms. Slack:

In your letter dated October 1, 2012, you requested a tariff classification ruling.

One sample was submitted, identified as Greenlite style 14412. Information was submitted on two additional Greenlite styles: 14413 and 14414. The sample is a white, plain woven fabric of filament yarns. You state that these products are composed of 100% cellulose filament from wood pulp, that they have not been dyed, bleached or printed, and that they weigh 220 g/m2, 190 g/m2 and 160 g/m2, respectively. Your correspondence indicates that these fabrics will be imported in widths of 100 cm, and will be used as reinforcement for bio-friendly composites.

The applicable subheading for Greenlite styles 14412 and 14413 will be 5408.21.0060, Harmonized Tariff Schedule of the United States (HTSUS), which provides for woven fabrics of artificial filament yarn, including woven fabrics obtained from materials of heading 5405: other woven fabrics, containing 85 percent or more by weight of artificial filament or strip or the like: unbleached or bleached, weighing more than 170 g/m2. The rate of duty will be 14.9%.

The applicable subheading for Greenlite style 14414 will be 5408.21.0030, HTSUS, which provides for woven fabrics of artificial filament yarn, including woven fabrics obtained from materials of heading 5405: other woven fabrics, containing 85 percent or more by weight of artificial filament or strip or the like: unbleached or bleached, weighing not more than 170 g/m2. The rate of duty will be 14.9%.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
